Product Safety and Technical Regulations Law No. 7223
The Law on Product Safety and Technical Regulations No 7223 was published in Turkish Official Gazette in 12 March 2020 and it entered into force one year after its publication, in March 2021. The law aims to set up a general framework to define the main characteristics of the product safety system such as technical regulations, conformity assessment, ce marking, market surviellance etc and defines the economic operators rights and responsibilities, the duties of the competent authorities, states the main principles to be followed and determines penalites for non-compliances against the established rules.
Due to Türkiye’s rights and responsibilities stemming from the Customs Union established with the EU in 1995, the Law no 7223 has been prepared in line with the related EU legislation. Thus the Law also adopts the main rules brought by the New Legislative Framework (NLF) and the Goods Package of the European Union. Additionaly the main principles of general product safety and product liability was laid down in the Law.
Main hightlights of the Framework Law are:
- Online trade has been included within the scope of the Law so that product sold online should also be safe and in compliance with the related technical regulations. Thus competent authorities will be able to carry out market surveillance activities for products sold online.
- Traceablity principle has been introduced to maintain the responsible economic operator for the unsafety/non compliance.
- The roles and responsibilities of the economic operators: manufacturer, importer, authorized representative distributor has been seperately defined and maintained.
- The recall of the unsafe products from the end user has been obligated.
- Product liability principle has been covered.
Effective notification of the public regarding unsafe products has been maintained as one of the key principles of the product safety system.
