Scope: This Regulation covers the rules to be applied to construction materials in terms of basic requirements for construction works, performance declaration, CE marking, obligations of economic enterprises, rules on harmonized technical specifications, evaluation, designation and surveillance of notified bodies and technical assessment bodies, notification authority, procedures and principles regarding market surveillance and inspection.
2) Regulation on the Criteria to be Subjected to Construction Materials

Scope: This Communique covers the technical specifications for building materials to be marked with the "G" mark within the scope of the Regulation on the Criteria to be Subjected to Construction Materials.
Basic Security Requirements (briefly describe):
All construction works must meet the basic requirements listed below:
1) Mechanical strength and stability.
2) Safety in case of fire.
3) Hygiene, health and environment.
4) Accessibility and safety in use.
5) Protection against noise.
6) Energy savings and heat preservation.
7) Sustainable use of natural resources.
In order to determine these 7 basic requirements, the product characteristics that must be declared are specified in harmonized technical specifications (for CE marking) and national technical specifications (for G marking).
Conformity Mark Required by the Legislation:
1) CE marking under the Construction Materials Regulation.
2) G marking under the Regulation on the Criteria to be Subjected to Construction Materials.
Conformity Assessment Procedure Required by the Legislation (briefly describe):
1) Under the Construction Materials Regulation:
Conformity assessment procedures of construction materials subject to European Union harmonized technical specifications are carried out by the manufacturer and, where necessary, by the notified body according to the systems of assessment and verification of constancy of performance (AVCP) systems which are given in Annex 5 of the Regulation. Within the scope of this Regulation, manufacturers are required to obtain a Certificate of Constancy of Performance or a Certificate of Conformity of the Factory Production Control or a Performance Evaluation Report issued by a notified body, depending on the AVCP system specified in the Regulation, before placing their products on the market. Based on these certificates and reports, manufacturers shall make a declaration of performance in accordance with the format in Annex 3 of the Regulation and affix CE marking to their products accordingly. Under System 4, manufacturers can affix CE marking to their products by making a declaration of performance without a certificate issued by a notified body.
2) Under the Regulation on the Criteria to be Subjected to Construction Materials:
The conformity assessment procedures of construction materials subject to national technical specifications shall be carried out according to the "conformity control methods" specified in Annex-1 (D) within the scope of the "conformity confirmation systems" specified in Annex-1 (E) of the Regulation and stipulated within the framework of the EU Commission Decisions. by the manufacturers and, where necessary, by the conformity assessment bodies (CAB) designated by the Ministry. Complementary conformity assessment procedures for CAB’s and manufacturers are determined by the Ministry.
According to this regulation manufacturers shall get a "G" Certificate of Conformity (Annex-1 (B) of the Regulation) issued by a CAB and / or issue a "G" Declaration of Conformity (Annex-1 (C) of the Regulation) and then affix the G mark accordingly, before placing on the market of their products.
Manufacturers which have an valid TSE Certificate (a voluntary certificate which atessts conformity with the standart by performing tests and surveillances issued by the National Standardization Body-TSE) may affix the G mark based on assessment reports obtained during this certification.
For products legally placed on the market in an eu member state, the provisions of the mutual recognition regulation shall apply in the unregulated area, which has been prepared taking into account the regulation (eu) no 2019/515 (dated 19.03.2019) of the european parliament and of the council.
Imported products brought directly from a third country may be placed on the market after their conformity is confirmed by the organizations specified in this Regulation.

2) Solid Fuel Product
Scope of the Legislation (briefly describe):
Regulation on Control of Air Pollution Caused by Heating
This Regulation; It covers the characteristics and operating principles of combustion plants to be used for heating, the quality criteria of solid, liquid and gaseous fuels to be used in combustion plants and the emission limits to be complied with.
Basic Security Requirements (briefly describe):
In order to reduce the negative effects of pollutants emitted into the outside air in the form of soot, smoke, dust, gas, steam and aerosols from combustion facilities used for heating purposes, it is the basic safety requirements for products to comply with the specifications specified in the Regulation.
Conformity Mark Required by the Legislation:
There is no specific mark of conformity required by legislation. However, it is obligatory to have the labels in Annex-6, Annex-7, Annex-8 and Annex-9 of the Regulation on the bags of the products put on the market in bags.
However, the product supply chain is provided by some documents given by our General Directorate. “Import Conformity Certificate" is given at the stage of solid fuel import. If the solid fuel is produced within the country, a “Conformity Permit” is issued. In addition, a “Sales Permit” is given to the solid fuel importer or manufacturer so that they can sell solid fuels. A “Distributor Registration Certificate” is given to carriers for the purpose of transporting solid fuel after import or production. Those who will sell the products are given a “Solid Fuel Seller Certificate”. During the issuance of all these documents, the product quality is controlled. The receipt of these documents does not constitute an obstacle to market surveillance.
Conformity Assessment Procedure Required by the Legislation (briefly describe):
Solid fuels to be inspected are primarily subject to document control during their import, production, storage, bagging, distribution or sale. Afterwards, a sample is taken from the product and sent to the accredited laboratory and inspected for compliance.

The regulation entered into force on 01 April 2005.
