Toys
Scope of the Legislation:
In accordance with Directive 2009/48/EC of the European Parliament and of the Council of 18 June 2009 on the safety of toys, products designed or intended, whether or not exclusively, for use in play by children under 14 years of age are fall within the scope of the Regulation except indicated products in scope part not which are not considered as toys such as playground equipment intended for public use; automatic playing machines, whether coin operated or not, intended for public use; toy vehicles equipped with combustion engines; toy steam engines; and slings and catapults.
Basic Security Requirements:
Ministry shall take all measures necessary to ensure that toys may not be placed on the market unless they comply with the essential safety requirements set out, as far as the general safety requirement is concerned, in paragraph 2, and, as far as the particular safety requirements are concerned, in Annex II. Toys, including the chemicals they contain, shall not jeopardise the safety or health of users or third parties when they are used as intended or in a foreseeable way, bearing in mind the behaviour of children. The ability of the users and, where appropriate, their supervisors shall be taken into account, in particular, in the case of toys which are intended for use by children under 36 months or by other specified age groups. Labels affixed in accordance with Article 12(2) and instructions for use which accompany toys shall draw the attention of users or their supervisors to the inherent hazards and risks of harm involved in using the toys, and to the ways of avoiding such hazards and risks. Toys placed on the market shall comply with the essential safety requirements during their foreseeable and normal period of use.
Conformity Mark Required by the Legislation:
Manufacturers obligate to affix “CE” marking on toy.
Conformity Assessment Procedure Required by the Legislation:
Before placing a toy on the market, manufacturers shall use the conformity assessment procedures in “Regulation on Conformity Assessment Procedures” which is aligned with Decision No 768/2008/EC of the European Parliament and of the Council. And before placing a toy on the market, importers shall ensure that the appropriate conformity assessment procedure has been carried out by the manufacturer.

Communique on the Harmonized Standards Regarding Toy Safety Regulation (Turkish Official Gazette No. 30025 Date: 1/4/2017)
Scope of the Legislation:
The list of the harmonized standards and reference numbers harmonized by the Turkish Standards Institute, regarding the European Parliament and Council Directive 2009/48/EC dated 18/6/2009 on the Safety of Toys, is set out in the annex of the Regulation.
Basic Security Requirements:
Harmonized standards and reference numbers regarding toy safety are indicated according to Article 14 of the Toy Safety Regulation.
Conformity Assessment Procedure Required by the Legislation:
Toys comply to the harmonized standards whose reference numbers are published in the Official Journal of the European Union or the corresponding Harmonized Turkish Standards or the relevant provisions, shall comply with the requirements in Article 11 of the Toy Safety Regulation and annex 2 which is covered by the mentioned standards or their relevant provisions is considered comply with the safety requirements.
